Maryam calls for Al-Azizia verdict to be declared void following judge Malik's removal

PML-N leader Maryam Nawaz on Friday called for the verdict against her father former prime minister Nawaz Sharif to be expunged following the Islamabad High Court's (IHC) decision to remove accountability judge Arshad Malik from his post.
In a series of posts shared on Twitter, Maryam said that the matter was not about the removal of a judge instead it was about suspending the verdict that the judge had issued.
"The matter is about removing the verdict, which this judge had given under pressure, from the court record."
Judge Malik, on Dec 4, 2018, had handed ousted prime minister Nawaz Sharif seven years in jail in the Al-Azizia Steel Mills corruption reference. He, however, had acquitted him in a second reference related to Flagship Investments, saying "there was no case against Nawaz".
In a subsequent post, Maryam said: "The clear meaning of the removal of the judge is that the judiciary has accepted the truth."
"If this is the case, how can a verdict by this judge being maintained?"
She asked why her father was not being released if the judge, who had given the verdict in the case against him, was removed.
In a third post, Maryam asked: "A judge [...] was found guilty of misconduct and was removed from his post; how can the subject of his misconduct be punished?"
Maryam said that an individual, who had remained the prime minister of Pakistan three times, was behind bars despite being proven to be innocent today.
"Is it enough to only remove the judge? Certainly not," she wrote.
She requested the judiciary to declare void the verdict against her father and to release him without any delays.
"Now this matter is not restricted just to Nawaz Sharif. I am turning to the judiciary for justice. I will keep waiting."
'Release Nawaz immediately'
While calling for the immediate release of Nawaz, Leader of the Opposition in the National Assembly Shehbaz Sharif said that the verdict against Nawaz had become void.
The president of the PML-N said that following the judge's removal, there was no justification for keeping Nawaz in jail.
"Keeping Nawaz Sharif in jail for even a minute is now illegal."
He said that the video and all the facts connected to it had been proven to be true.
"The verdict given against Nawaz Sharif under pressure should be declared void."
Nullify the verdict, release Nawaz: PML-N
The PML-N was quick to react to the news regarding the removal of the judge, with its spokesperson Marriyum Aurangzeb saying that the verdict against Nawaz Sharif should be declared null and void and he should "be released immediately".
"It has been confirmed that the video is real," she said in a statement shared by the PML-N on Twitter, adding: "[The] judge sahib has conceded that he made the decisions under pressure."
Aurangzeb said that after the removal of the judge, the legal basis for the verdict against Nawaz had automatically ended.
"After the removal of the judge, it has been proven that the facts that Maryam Nawaz brought before the people of Pakistan were correct."

Last time Nawaz was sentenced to 35 years in prison for plane hijacking. He is 70 years old let him spent his rest of life in peace and stop being paranoid. Apart from personal affiliation with any political party people should try to understand that ACJ of IHC has recommended to remove Judge Arshad Malik from his position in the case of video leaks concerning Nawaz Sharif as judges are not suppose to develop personal rapport with any one whereas accused judge have met with number of times with PMLN sympathizers on several occasions.
The action has been taken by ACJ of IHC after meeting with Judge Arshad Malik in which he submitted clarifications.

No chance of retrial. If retrial is to be conducted, it will be done in both cases. Apparently it seems that the judge under immense pressure of PMLN decided to favour NS family in one case and held guilty in other case, as thrashing out both cases would be more troublesome for the judge on revelation of these controversial material at any later stage.Retrial would make sense if judge's affidavit corroborated the claim of Maryam Safdar i.e. instead he revealed that PMLN had mounted pressure.

Emotional blackmailing will not work Ms Maryam Safdar. The questions remained to be answered: why Nawaz Sharif did not submit evidence of his assets beyond means and, how the money was earned, transferred and properties purchased etc? The Avenfield case was concluded on evidences presented from both sides, so its verdict still stands, as jude Arshid Malik already said in his verdict that he was not under any pressure or influence from anybody and his decision was based on evidences presented.

Maryam sounds so impatient about the release of her father. So the question is why is she not submitting an application to the court for that? Why does she seem so desperate for the court to take Suo Motu notice in spite of the fact that PMLN was critical of former CJ Saqib Nisar taking such notices?
Maryam knows if she submits an application, she will have to prove the authenticity of any tapes. She is trying to force the court to make a decision based on the doubts only without proving tapes.

Maryam knows it would be nigh impossible to repeat her calibri font tactics with such anslysis, so she is not submitting an application. If court takes a Suo Motu notices and throws the tapes out, she will claim political motives behind that. Courts should simply summon her under contempt notice.

What the court should not do under any circumstance is to try to get these tapes analysed themselves. This would give PMLN another propaganda opportunity if they are proven corrupted. By asking Maryam to prove the authenticity, they leave themselves a chance to get any initial findings verified. But Maryam Safdar should be made to prove the authenticity of these tapes. Otherwise we will keep seeing such edited tapes to create doubts in future.

Another reason to everse the decision is possible if the judge has shown any bias in favor or against the petitioner(,in this case NS), only then the judgement will be affected. Even if we take judge's sworn affidavit as accurate, was not he responsible to letting his institution know of any approaches by PMLN? Was not he able and responsible to prosecute the person offering brides or threats?

Now even in manipulated system, they have to concede for re-trial in this case. But those known unknown are very strong and they will jail Nawaz and his daughter in some other false case. But it has to be seen how long they can do it as they are generally coward and hit from the back.

@M. Saeed: What logic? I did mega fraud and stole huge amount belonging to someone who trusted me (like Pakistan trusted NS), get convicted and then bring video to make the judge contraversal ... and start demanding that I should be released and my conviction should become void. :)

@N_Saq, Your assumptions are incorrect that the judge and his cases are now disqualified. Judge has been put aside from his daily work to focus on the investigation of the fake video cases and his allegation of attempts by Sharif family members to bribe him case, and has not been disqualified as a man of law.

The affidavit submitted by the judge is enough to prove that his verdict had no bearing from the offers or threats. The judgement was given in all honesty.
